1. Acceptance of Terms

Welcome to KiwiBot! These Terms of Service ("Terms") govern your access to and use of KiwiBot, a Discord bot service operated at https://kiwibot.app ("we," "our," or "us").

By using KiwiBot, authenticating your Discord account, or interacting with our services in any way, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use KiwiBot.

KiwiBot operates on the Discord platform. By using KiwiBot, you also agree to comply with Discord's Terms of Service and Community Guidelines.

2. Description of Service

KiwiBot is a Discord bot that provides various features and functionality to Discord servers and their members. Our services include but are not limited to:

• User authentication and verification
• Server management tools
• Interactive commands and features
• Community engagement tools

We reserve the right to modify, suspend, or discontinue any aspect of KiwiBot at any time without prior notice.

3. User Eligibility

To use KiwiBot, you must:

• Be at least 13 years old (or the minimum age required in your jurisdiction)
• Have a valid Discord account in good standing
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the service under applicable law

If you are under 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use KiwiBot.

4. Account and Authentication

KiwiBot uses Discord's OAuth system for authentication. When you authenticate with KiwiBot:

• You authorize us to access certain information from your Discord account as described in our Privacy Policy
• You are responsible for maintaining the security of your Discord account
• You agree to notify us immediately of any unauthorized use of your account
• You acknowledge that you are responsible for all activities that occur through your authenticated account

5. Acceptable Use

When using KiwiBot, you agree NOT to:

• Abuse or exploit the service, including attempting to gain unauthorized access to KiwiBot's systems or other users' data
• Use automated systems (bots, scripts, etc.) to interact with KiwiBot in ways not intended by the service
• Harass, threaten, or abuse other users or use KiwiBot to facilitate such behavior
• Spam or flood commands or messages through KiwiBot
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Share illegal content or use KiwiBot for any illegal purpose
• Attempt to reverse engineer or extract source code from KiwiBot
• Interfere with or disrupt KiwiBot's services or servers
• Violate Discord's Terms of Service or Community Guidelines while using KiwiBot
• Use KiwiBot to distribute malware, viruses, or any harmful code

6. Server Administrator Responsibilities

If you are a Discord server administrator who adds KiwiBot to your server:

• You represent that you have the authority to add bots to the server
• You are responsible for how KiwiBot is configured and used within your server
• You agree to comply with Discord's bot usage guidelines
• You acknowledge that removing KiwiBot from your server may affect user data and functionality

7. Intellectual Property

KiwiBot, including its name, logo, code, design, and all related materials, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to use our intellectual property except as necessary to use the service as intended.

You retain ownership of any content you submit through KiwiBot, but you grant us a license to use, store, and process that content as necessary to provide the service.

8. Privacy and Data Protection

Your use of KiwiBot is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using KiwiBot, you consent to our data practices as described in the Privacy Policy.

9. Service Availability and Modifications

We strive to keep KiwiBot available and functional, but we do not guarantee:

• Uninterrupted or error-free operation
• That KiwiBot will be available at all times
• That any defects will be corrected immediately
• That KiwiBot will be compatible with all Discord servers or configurations

We reserve the right to modify, update, or discontinue KiwiBot or any features at any time without prior notice or liability.

10. Termination

We reserve the right to suspend or terminate your access to KiwiBot at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Violation of Discord's Terms of Service
• Fraudulent, abusive, or illegal activity
• At our sole discretion

You may stop using KiwiBot at any time. Upon termination, your data will be handled according to our Privacy Policy.

11. Disclaimers

KiwiBot is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of any content or information provided through KiwiBot
• That KiwiBot will meet your requirements or be secure, timely, or error-free

We do not warrant that KiwiBot will be compatible with all hardware, software, or systems.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

This includes but is not limited to damages resulting from:

• Your use or inability to use KiwiBot
• Unauthorized access to or alteration of your data
• Any conduct or content of any third party on the service
• Any content obtained from KiwiBot

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless KiwiBot, its operators, affiliates, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of KiwiBot
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of KiwiBot shall be resolved through:

• Good faith negotiation between the parties
• If negotiation fails, binding arbitration or mediation as permitted by law
• In the courts of competent jurisdiction in our operating jurisdiction

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users through Discord or other reasonable means
• Provide a reasonable period for you to review the changes

Your continued use of KiwiBot after changes to these Terms constitutes your acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KiwiBot regarding your use of the service and supersede any prior agreements.
